The plaintiffs in the class action lawsuit alleged that Anywhere Real Estate, Inc. f/k/a Realogy Holdings Corp., RE/MAX LLC, Keller Williams Realty, Inc., the National Association of Realtors, Compass, The Real Brokerage, At World Properties, Realty ONE Group, and Douglas Elliman (collectively, the “Settling Defendants”) engaged in an anticompetitive agreement that forced home sellers to pay increased commissions, which constituted a violation of antitrust law.
The plaintiffs won at trial. Various defendants have appealed. However, the Settling Defendants settled with the plaintiffs instead of pursuing an appeal.
The settlements have resulted in the Settling Defendants being responsible for depositing over $980 million to be paid to class members with valid claims. It is important to know that you do not need to have used one of the Settling Defendants as your broker or agent in order to have a valid claim. Instead, to have a valid claim, you must have done all of the following:
(a) Sold a home during the required date range (see below).
(b) Listed the home you sold on a multiple listing service anywhere in the United States.
(c) Paid a commission to a real estate broker in connection with the sale.
Generally, the required date range depends on which broker and/or multiple listing service you used.
However, if your home was listed on a multiple listing service ANYWHERE IN THE UNITED STATES between February 1, 2020 and February 1, 2024, and you paid a commission to any real estate broker in connection with the sale, you have the right to make a claim.
The deadline for submitting a claim to the court-appointed settlement administrator is May 9, 2025. This means that you must sign up with RECACA by April 9, 2025 in order to give RECACA sufficient time to submit your claim by May 9, 2025 to the court-appointed settlement administrator.
Claimants have until May 9, 2025 to submit claims to the court-appointed settlement administrator. Settlement payments should be distributed some time after that date.
The attorneys representing the class members still need to submit and get Court approval of a "Plan of Allocation." The Plan of Allocation will describe how much money will be paid for each claim. As of now, a Plan of Allocation has not been submitted to or approved by the Court. Once a Plan of Allocation is approved by the Court, we will update the answer to this question. Current court filings indicate that claims could be paid "pro-rata." This means that the more you paid in commissions, the more money you could potentially receive.
If your claim is successful, we'll charge a fee equal to one-third (33.33%) of the compensation awarded to you. If your claim is unsuccessful, there is no cost to you. Class Member may choose to file a claim on their own utilizing the Settlement Administrator’s official website at no additional charge or expense to the Class Member. The Settlement Administrator is available to assist Class Members in submitting their claims and answer any questions they may have.
